Effective May 16, 2019, the U.S. Bureau of Industry and Security (BIS) amended the Export Administration Regulations (EAR) by adding Huawei Technologies Co., Ltd. (Huawei) to the Entity List. Huawei has been determined by the U.S. Government to be acting contrary to the national security or foreign policy interests of the United States. BIS is also adding Huawei’s non-U.S. affiliates to the Entity List because they pose a significant risk of becoming involved in activities contrary to the national security or foreign policy interests of the United States due to their relationship with Huawei.
The newly added entities to the Entity List can be found below: https://www.bis.doc.gov/index.php/documents/regulations-docs/2394-huawei-and-affiliates-entity-list-rule/file
What does this mean at the Berkeley lab?
- Lab personnel may not engage in any activities (current or future) with entities identified on the Entity List
- Any items associated with the listed entities must be taken out of service and discarded
- Entity screening tools must be used to prevent any items from being exported or imported to these entities
